A proposed settlement has been reached in a class action lawsuit alleging violations of certain laws that prohibit misleading labeling and false advertising of CoQ-10 supplements. Defendants deny all of these allegations. The Court did not rule in favor of Plaintiffs or Defendants. Instead, because of the complexity and uncertainty of litigation, the parties compromised and negotiated a proposed settlement in order to avoid the expense and risks of continuing with the lawsuit. The court has preliminarily approved the proposed settlement.

  • Walgreens Well at Walgreens CoQ-10 Enhanced Absorption Formula 200 mg
  • Meijer’s Ultra CoQ-10 100 mg

YOUR OPTIONS AND IMPORTANT DEADLINES IN THIS SETTLEMENT
SUBMIT A CLAIM FORM POSTMARKED BY SEPTEMBER 4, 2018 This is the only way to claim a product credit or a partial cash refund from the Settlement Fund. You can file a claim online.  Or mail in a paper claim form.
EXCLUDE YOURSELF FROM THE CLASS BY SEPTEMBER 4, 2018 If you choose not to participate in the settlement (“opt-out” of the settlement), you (a) will not be a member of the settlement class and (b) will not be eligible to receive the Settlement Benefits. You will keep your right to sue on your own regarding any claims that are part of the settlement. You can find an opt-out form opt-out form online here.
OBJECT OR COMMENT BY SEPTEMBER 4, 2018 You may write to the Court about why you do, or do not, like the Settlement. You must remain a member of the settlement class to comment in support of or in opposition to the settlement.
APPEAR IN THE LAWSUIT OR ATTEND
A HEARING ON NOVEMBER 29, 2018
You may ask to speak in Court about the fairness of the settlement. You may appear in Court at the final approval hearing or hire an attorney at your own expense, if you so desire.
DO NOTHING If you do nothing, you will receive no reimbursement. You also give up your right to sue on your own regarding any claims that are part of the settlement.
